General Terms and Conditions of the Company Fabian Striebe – Ornamental and Useful Plants (Carniflor)

1 Applicability to Entrepreneurs and Definitions of Terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who concludes a legal transaction for purposes that cannot predominantly be attributed to their commercial or independent professional activity (§ 13 BGB).

2 Conclusion of a contract, storage of the contract text

(1) The following regulations regarding the conclusion of the contract apply to orders placed through the online shop on the website https://www.carniflor.de (shop.carniflor.de), for personal orders via email, or for purchases on the EBay platform.

(2) If the contract is concluded, the contract comes with it

(3) The presentation of goods on any sales platform does not constitute a legally binding contractual offer on our part, but rather shows, unless expressly marked otherwise, individual pieces similar to and representative of the object for sale. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.

The acceptance of the offer is made in writing or in text form or by sending the ordered goods within two weeks. After the fruitless expiration of the deadline, the offer is considered rejected.

(4) Upon receipt of an order, the following regulations apply: The consumer makes a binding contractual offer by successfully completing the ordering procedure provided in our online shop.

The order takes place in the following steps:

1) Selection of the desired goods
2) Confirm by clicking the buttons "Order", "Buy Now", "Purchase", "Add to Cart", "Buy Immediately"
3) Checking the information in the shopping cart
4) Activation of the buttons "to checkout", "complete order", "finish order process"
5) if applicable, registration in the online shop after registration and entry of the registration details (email address and password).
6) Re-checking or correcting the respective data entered.
7) Binding submission of the order by clicking the button "order for a fee" or "buy", "complete the order process with payment obligation", "buy now", "buy immediately", etc.

The consumer can return to the website where the customer's information is collected and correct input errors by pressing the "Back" button in the Internet browser they are using before the binding submission of the order. Alternatively, they can cancel the ordering process by closing the Internet browser. The receipt of the order is confirmed immediately by an automatically generated email (order confirmation). However, this does not yet constitute acceptance of the offer. Acceptance of the offer occurs in writing, in text form, or by sending the ordered goods within one week.

(5) Storage of the contract text for orders: The contract text is electronically secured by us, and we will subsequently send you the order data and our terms and conditions (via email). You can also view the terms and conditions at any time at https://www.carniflor.de/impressum/agb/. You can view your past orders in your account under My Account –> My Orders or Overview Purchases.

3 Prices, Shipping Costs, Payment, Due Date

(1) The prices stated do not include VAT due to the small business regulation. However, other price components are included. Any shipping costs will be added.

(2) The consumer has the option to make payment in advance (PayPal or bank transfer). In addition, the payment methods credit card (Visa, MasterCard, Maestro, American Express) and Klarna (invoice purchase) are available via Shopify Payments, as well as potentially other providers.

(3) If the consumer has chosen to pay in advance, he undertakes to pay the purchase price immediately after conclusion of the contract.

(4) If the consumer has chosen to pay by invoice, he is obliged to pay the purchase price immediately within seven days of receiving the invoice. In the case of invoice purchases through the provider Klarna, the respective terms and conditions and payment deadlines of the payment service provider apply.
"We reserve the right to deliver the ordered goods only after payment in advance, even without giving reasons, especially for higher-value orders or orders from new customers."

4 Delivery

(1) Unless otherwise clearly stated in the product description, all items we offer are ready for shipment immediately (within a processing time of about two working days). Delivery will take place at the latest within 7 working days. The delivery period begins in the case of payment in advance on the day after the payment order is given to the bank instructed with the transfer, and for all other payment methods on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or public holiday at the delivery location, the period ends on the next working day. In case of high summer temperatures or multi-day frost, there may also be delivery delays to protect the goods.

(2) The risk of accidental loss and accidental deterioration of the sold item during the shipping process is borne by the buyer. Damages to the delivery and/or the goods must be reported immediately by email.

(3) Merchandise items such as T-shirts, hoodies, mugs, or similar items are partially processed through our external partner "Spreadshirt" ("SPOD"), sprd.net AG, Gießerstraße 27, 04229 Leipzig. Additional fees may apply for delivery. By purchasing such items, you agree that we will forward your submitted data (in particular, your full name and complete delivery address) to our partner.

5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

6 vouchers

Vouchers are valid for three years from the date of issue.
A payout of the amount or of partial and/or remaining amounts is not possible.
Furthermore, both the exchange and the return of vouchers are excluded.

Consumers have a right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who concludes a legal transaction for purposes that cannot be predominantly attributed to either their commercial or independent professional activity:

You have the right to cancel this contract within fourteen days without giving any reasons.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

by means of a clear declaration (e.g. a letter sent by post, fax, or email) stating your decision to withdraw from this contract. Returning the goods in their original condition is also considered a withdrawal. You may use the attached sample withdrawal form, which is not mandatory. Goods that are no longer in their original condition are excluded from withdrawal.

Consequences of revocation

"If you revoke this contract, we will refund you all payments we have received from you, minus delivery costs and any transaction fees incurred, without delay and no later than fourteen days from the day we receive your notice of revocation of this contract. For this refund, we will use the same payment method that you used for the original transaction, unless something else has been expressly agreed upon with you; in no case will you be charged any fees for this refund."

"We can refuse the refund until we have received the goods back, the goods are no longer in their original condition, or until you have provided proof that you have returned the goods, whichever is the earlier date."

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you inform us of your cancellation of this contract. The deadline is met if you send the goods before the fourteen day period has expired.

You bear the direct costs of returning the goods.
